Terms and Conditions

The Terms and Conditions of the PROALP online store are drafted in accordance with the Consumer Protection Act (ZVPot), the EU General Data Protection Regulation (GDPR), based on the recommendations of the Chamber of Commerce and Industry of Slovenia, and international e-commerce codes. The Terms and Conditions address the operation of the online store, user rights, and the business relationship between the provider and the buyer.

PROALP online sales are conducted by Proalp, Lom pod Storžičem 74, 4290 Tržič, email info@proalp.si (hereinafter referred to as the provider). The company is registered with the District Court in Kranj, registration number 1195735. The company is liable for VAT (VAT ID: SI86585410).

The sales terms define the rights and obligations of buyers when ordering products available on the website www.proalp.si and the business relationship between the provider and the buyer. By using the website www.proalp.si, the user accepts and agrees to all provisions of the Terms and Conditions. If you do not agree with these Terms and Conditions, we ask you to immediately stop accessing the website.

INTELLECTUAL PROPERTY RIGHTS

The entire content of the website, regardless of form (text, images, videos, sounds, etc.), is protected by copyright. The content of the website may not be used for any purpose other than the user’s personal viewing, unless the provider expressly permits otherwise in writing. In case of misuse, the user is criminally and financially liable. The provider of the online store is the holder of all copyrights.
The provider is the owner of the trademark and has all rights to use it. The provider also has all rights to other products found on the website. The trademarks on the site are protected in accordance with national and international legislation. In case of trademark misuse, the user is criminally and financially liable.

ONLINE STORE

Users can shop through the website, which is accessible via www.proalp.si. These Terms and Conditions are an integral part of the contractual relationship between the provider and the buyer – the purchase agreement.

By registering on the website or placing an order through the online store, the user confirms that they understand and accept the Terms and Conditions. The provider makes every effort to ensure accurate information found in the online store (product descriptions, photos, etc.). All products in the online store are manufactured by Proalp d.o.o. and are always available for order. For products that are currently out of stock or require customization, we reserve the right to extend the order dispatch time as long as necessary for production or customization of the new product, with this time not exceeding 14 days.

ORDERING PROCESS

You can order our products in the online store, by phone, or by email.

Select the footwear and the correct size you wish to purchase, then click the Add to Cart button. The selected item will appear in the cart. If you want to purchase another item, click Continue Shopping, or if you want to complete your purchase, click Checkout. You can remove a selected item from the cart by clicking the X button. The next steps include optional login or registration, entering billing and delivery addresses, delivery and payment method. Complete your purchase by clicking the Confirm Purchase button.

PRICES AND TAXES

All prices are expressed in EUR. Prices include value-added tax (22% VAT), as we are a VAT payer. Product prices do not include delivery costs or postage. These are stated when calculating the order value before electronic order confirmation.

SHIPPING AND PAYMENT METHODS

We ship your ordered footwear and accessories via GLS Slovenia or Pošta Slovenija express mail, with whom we have a contractual relationship. This shipping method is most convenient for our customers. We dispatch orders that are in stock within one to two business days. For products that are not in stock, the dispatch time is 5 to 14 days.

The final postage amount is known before completing the purchase.

We ship Proalp footwear to users in nearby European markets.

Payment on Delivery

You pay for the ordered goods upon receipt, and you have several payment methods available:

  • cash,
  • Aktiva, Maestro, Mastercard, Visa, Visa Electron cards

It is recommended that you also enter a contact phone number where you can be called upon delivery to arrange a convenient delivery time.

Payment by Proforma Invoice

You pay for the ordered goods in your online bank or with a payment slip (UPN) at any post office or bank. We will dispatch the ordered goods immediately after receiving payment (applies to goods in stock) or immediately after production.

Cash Payment on Personal Collection

When personally collecting ordered goods at our stores, you can pay with cash or a payment card.

User Registration

Registration is not required for purchase. Each registered user has their own username and password for identification. The password is confidential and known only to the user. For business purposes, we collect the following data:

  1. name, surname, address, and place of residence,
  2. email address,
  3. username,
  4. password in encrypted form,
  5. and other data that the user enters in the form on the website www.proalp.si
  6. phone number for contact with the carrier

The purchase agreement (invoice) is concluded in Slovenian. It is stored at the provider’s headquarters and is available to the buyer every business day between 10 AM and 3 PM.

ORDER CANCELLATION

When a user places an order, they receive an email confirming receipt of the order. The user has the right to cancel the order before receiving electronic notification from the provider that the shipment has been dispatched. Orders for products that are being made according to individual foot measurements or color choices cannot be canceled.

The contract or order is sent to the buyer at the email address they entered when placing the order. We store it electronically at the company’s headquarters. The buyer can request a copy (invoice) via our email address info@proalp.si.

The online store provides technical means to identify and correct errors before submitting an order, as the page alerts the buyer if they have not completed all required fields for order submission. Before submitting the order, a summary is available where the buyer can check and edit their entered data. In case of incorrect entry, the buyer can correct errors in the cart. To cancel an order, the user sends an email to info@proalp.si, stating their name and surname, address, order number, and order date.

WITHDRAWAL FROM CONTRACT, RETURN AND EXCHANGE OF FOOTWEAR

The sixth paragraph of Article 43d of the ZVPot stipulates that if the consumer has already received the goods and withdraws from the contract, they must return them to the company or a person authorized by the company to collect the goods (e.g., a seller at a regular Proalp store), immediately or at the latest within 14 days. In case of withdrawal from the contract, the company must return all payments charged to the consumer upon conclusion of the contract (order placement) within 14 days of receiving the goods. Refunds are not made in cash.

The buyer has the right to withdraw without stating a reason for their decision. Any complaints are resolved promptly.

The product you wish to return must be unworn, unwashed, clean, and undamaged.

Footwear and other products made according to your individual order cannot be returned or exchanged, so we recommend that you try on the desired model carefully before ordering.

You can return the product to the company headquarters at Proalp, Lom pod Storžičem 74, 4290 Tržič, together with the invoice at your expense within 14 days of receipt. You can avoid postage costs by bringing the footwear together with the invoice to our sales locations. For the value of returned products, you can choose another product or we will refund the purchase price to your bank account within 14 days of receiving the request and returned product. To refund the purchase price, we need the returned product (in the condition described at the beginning of the paragraph) and a submitted request to info@proalp.si, stating: your name and surname, address, order number (for online orders), order date, and reason for return. If you want a refund (instead of product exchange), also include your bank account number (TRR) in the request.

If you have provided an incorrect bank account number, we charge a fee of 30 EUR for additional work in resolving the case with the bank and the unauthorized recipient.

In case of withdrawal from the contract, the provider reserves the right to claim compensation for the reduced value of the goods.

Cash refunds are not possible.

For returns of products paid by credit card, we refund the purchase price for the returned product to the credit card. For returns of products paid by cash on delivery or bank transfer, we refund the purchase price to your transaction account.

By ordering a shipment, the buyer agrees that if they do not collect the shipment, Proalp d.o.o. will charge the buyer for the postage of the sent and returned package. The costs associated with returning goods in case of withdrawal from the contract are borne by the user.

MATERIAL DEFECT

When a buyer discovers that our product has a material defect, they must provide us with a detailed written description of the defect within the legally prescribed period and allow us to inspect the item. Based on this, we will agree on repairing the defect or replacing the product. The provider is not liable for material defects in the product that appear after two years from when the product was delivered.

COMPLAINTS AND DISPUTES

The provider respects current consumer protection legislation. The provider makes every effort to fulfill its obligation to establish an effective complaint handling system and designate a person with whom the buyer can connect by phone or email in case of problems. Complaints are submitted via email at info@proalp.si. The complaint handling process is confidential.

The provider will confirm receipt of the complaint within five business days and inform the buyer within eight business days how long it will take to process it, keeping them informed about the progress of the procedure.

The provider is aware that an essential characteristic of a consumer dispute, at least regarding judicial resolution, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle preventing consumers from initiating disputes in court. Therefore, the provider strives to the best of its ability to resolve any disputes amicably. If an amicable resolution of disputes is not possible, the court in Kranj has jurisdiction to resolve all disputes between the provider and the buyer.

In accordance with legal regulations, Proalp d.o.o. does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Act on Out-of-Court Resolution of Consumer Disputes.

Proalp, as a provider of goods and services enabling an online store in the territory of the Republic of Slovenia, publishes on its website an electronic link to the platform for online resolution of consumer disputes (ODR). The platform is available to consumers at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=SL

This regulation is based on the Act on Out-of-Court Resolution of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.

For all relationships, rights, and obligations not regulated by these Terms and Conditions, the provisions of the Code of Obligations, the Electronic Commerce Market Act, the Personal Data Protection Act, and the Consumer Protection Act apply accordingly.

WARRANTY

The provider sells products of verified quality. The owner of the Proalp brand is Proalp d.o.o. All products are original.

LIMITATION OF LIABILITY

The provider makes every effort to ensure the accuracy and correctness of the information published in the online store. The user must ensure adequate equipment protection before entering the online store. However, product characteristics, delivery time, or price may change so quickly that the provider cannot update the information in the online store. In such cases, the provider will inform the buyer of the changes and allow them to withdraw from the order or exchange the ordered item.

The provider reserves the right to disable the website or restrict access to it due to technical or other difficulties and maintenance, which also means disabling or hindering the use of the online store. The provider is not liable for compensation for any loss, costs, or damage incurred by the user due to the cessation of the online store’s operation.

We reserve the right to exceptionally withdraw from order execution if the order form was not completed in accordance with the Terms and Conditions, if the ordered product can no longer be provided, if there was an obvious error in the price list, or if the footwear characteristics do not match individual foot measurements. In all such and similar cases, we will immediately inform you of any withdrawal from the contract on our part.

By confirming your order, you confirm that you are familiar with the full text of the Terms and Conditions stated here and that you were expressly notified of these terms at the time of purchase.

COOKIES

A cookie is a small file that typically contains a sequence of letters or numbers that is loaded onto the user’s computer when they visit a particular website. Each time they revisit, the website will retrieve information about the loaded cookie and recognize the user.

SECURITY

Shopping in the Proalp online store is completely safe. We have ensured this with all the latest measures to protect your confidential data.

RIGHT TO INFORMATION

We are aware that the privacy of visitors to our online store is very important. Therefore, we guarantee 100% protection and security of your personal data in accordance with the Personal Data Protection Act.

We will keep all personal data confidential and will not disclose them to anyone without your prior consent. We will only entrust the delivery service with your delivery address.

By concluding a purchase agreement, you agree that we store and use your data for internal archive and statistical purposes and for communication necessary to execute the order.

The registered user is also responsible for protecting personal data by ensuring the security of their username and password.

However, some information is automatically collected using cookies and web beacons (“pixel tags”), standard tools in the web industry. The use of cookies and beacons allows us to recognize your IP address, the type of browser you are using, and your general online activity. If you disable cookies in your computer, you cannot make a purchase in the online store, as we need your personal data for the purchase. We do not disclose the data you provide to third parties, except for the purpose of confirming the validity of payment card purchases and product delivery. You can view, change, or request deletion of your personal data at info@proalp.si. The user is also responsible for protecting personal data by ensuring the security of their username and password and appropriate software (antivirus) protection of their computer. LAW

The court in Slovenia has jurisdiction to resolve any disputes. In accordance with legislation, the provider does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Act on Out-of-Court Resolution of Consumer Disputes.

The invalidity of any term does not cause the invalidity of other terms. In accordance with ZIsRPS, the buyer can submit an initiative to start an out-of-court consumer dispute resolution procedure through the European platform for online resolution of consumer disputes (ODR). The Terms and Conditions take effect from January 17. 2022.
